E3 EVENTS — Terms of Service
1. Agreement to Terms
By submitting a booking request or making a payment to E3 Studio ("Provider," "we," "us," or "our"), you ("Client," "you," or "your") agree to be bound by these Terms of Service ("Terms"). These Terms constitute a legally binding agreement between you and E3 Studio.
If you do not agree to these Terms, please do not proceed with your booking.
2. Services
E3 Studio provides studio rental services for commercial productions, photography, film, video, and related creative projects ("Services"). The specific Services, dates, rates, and conditions for your rental will be outlined in your booking confirmation.
3. Booking & Reservation
3.1 Booking Request
All bookings are subject to availability and approval by E3 Studio. Submission of a booking request does not guarantee reservation.
3.2 Confirmation
Your booking is confirmed only upon:
Approval by E3 Studio
Receipt of the required Deposit (defined in Section 4.1)
3.3 Reservation Hold
Upon payment of the Deposit, your requested date(s) will be reserved exclusively for your use during the agreed-upon time period.
4. Payment Terms
4.1 Deposit
A non-refundable deposit ("Deposit") is required to secure your booking. The Deposit amount will be specified in your booking confirmation. Payment of the Deposit authorizes E3 Studio to save your payment method for future charges as described herein.
4.2 Final Balance
The remaining balance ("Final Balance") is due seven (7) calendar days prior to your scheduled event date. You will receive an invoice with updated charges and a payment link. Failure to pay the Final Balance by the due date may result in cancellation of your booking.
4.3 Security Hold
On the day of your event (or one business day prior), E3 Studio will place an authorization hold ("Security Hold") on your saved payment method. The Security Hold:
Is not a charge unless captured
Covers potential damages, extended time, or additional services
Will be released within forty-eight (48) hours after your event concludes, provided no additional charges apply
Authorization holds expire after seven (7) days per card network rules
4.4 Payment Authorization
By providing your payment information, you authorize E3 Studio to:
Charge the Deposit at the time of booking
Charge the Final Balance seven (7) days prior to your event
Place a Security Hold on the day of your event
Capture all or part of the Security Hold if damages, extended time, or additional services apply
Charge your saved payment method for any amounts exceeding the Security Hold
4.5 Accepted Payment Methods
We accept major credit and debit cards. All payments are processed securely through Stripe. Your payment information is encrypted and never stored on our servers.
5. Cancellation & Refunds
5.1 Client Cancellation
30+ days before event: Deposit is forfeited; no additional charges apply
15-29 days before event: 50% of total rental amount is due
14 days or less before event: 100% of total rental amount is due
5.2 Provider Cancellation
If E3 Studio must cancel your booking due to circumstances within our control, you will receive a full refund of all amounts paid, including the Deposit.
5.3 Film Production Priority
E3 Studio is, at its core, a film production facility. Film and studio rental productions will always take priority over events. If a film production requires your reserved date(s), E3 Studio reserves the right to cancel your event booking with at least seven (7) days' notice. In such cases, you will receive a full refund of all amounts paid, including the Deposit and any Final Balance already charged.
5.4 Force Majeure
Neither party shall be liable for cancellation due to events beyond reasonable control, including but not limited to natural disasters, government actions, or public health emergencies. In such cases, the parties will work in good faith to reschedule or provide credit.
6. Use of Premises
6.1 Permitted Use
The studio may be used only for the purposes described in your booking confirmation. Any change in use requires prior written approval.
6.2 Prohibited Activities
The following are prohibited without prior written consent:
Open flames, pyrotechnics, or smoke machines
Live animals
Hazardous materials
Activities that may damage the premises
Subletting or transferring your booking to a third party
6.3 Compliance
You agree to comply with all applicable laws, regulations, and building codes while on the premises.
7. Damages & Liability
7.1 Responsibility for Damages
You are responsible for any damage to the studio, equipment, or property caused by you, your employees, contractors, guests, or vendors during your rental period.
7.2 Damage Assessment
E3 Studio staff will conduct a walk-through inspection before and after your event. Any damages identified will be documented with photographs and a written report.
7.3 Damage Charges
If damages occur:
We will provide you with a damage report and cost estimate
Charges will first be captured from the Security Hold
Any amount exceeding the Security Hold will be charged to your saved payment method
If additional payment is required, you will receive an updated invoice
7.4 Limitation of Liability
To the maximum extent permitted by law, E3 Studio's total liability for any claim arising from these Terms shall not exceed the total amount paid by you for the specific booking in question.
7.5 Client Insurance
We strongly recommend that you obtain appropriate production insurance covering general liability, equipment, and property damage for your event.
8. Time & Access
8.1 Arrival & Departure
Your rental period begins and ends at the times specified in your booking confirmation. You must vacate the premises by the agreed-upon end time.
8.2 Extended Time
If you require additional time beyond your reserved period, you must request approval from E3 Studio staff. Extended time is subject to availability and will be charged at the applicable hourly rate, captured from your Security Hold or charged to your saved payment method.
8.3 Early Arrival
Access prior to your scheduled start time is not guaranteed and may incur additional charges.
10. Indemnification
You agree to indemnify, defend, and hold harmless E3 Studio, its owners, employees, and agents from any claims, damages, losses, or expenses (including reasonable attorneys' fees) arising from:
Your use of the premises
Violation of these Terms
Actions of your employees, contractors, guests, or vendors
Any third-party claims related to your event
11. Privacy
Your personal and payment information is handled in accordance with our Privacy Policy. We use Stripe for payment processing; your payment data is subject to Stripe's privacy practices.
12. Modifications
E3 Studio reserves the right to modify these Terms at any time. Changes will be effective upon posting. Your continued use of our Services after changes are posted constitutes acceptance of the modified Terms.
13. Governing Law
These Terms shall be governed by and construed in accordance with the laws of the State of Utah, without regard to conflict of law principles.
14. Dispute Resolution
Any disputes arising from these Terms shall first be addressed through good-faith negotiation. If unresolved, disputes shall be submitted to binding arbitration in Salt Lake City, Utah under the rules of the American Arbitration Association.
15. Entire Agreement
These Terms, together with your booking confirmation and any additional agreements signed by both parties, constitute the entire agreement between you and E3 Studio regarding your booking.
